Legal Costs
Definitions
Cost refers to the legal costs which I am responsible for by law.
Policy Benefits
iWYZE will compensate me up to a fixed limit for any legal costs resulting from any civil action brought by or against me, or my defence against any criminal charges brought against me.
Exclusions
- Prospects of Success - If costs are incurred for legal action and the prospects of success are not reasonable.
- Employment - The legal action arises out of my employment, business, profession, occupation or any activity for reward.
- Ownership of Vehicles - The legal action arises out of the ownership or use of any motor vehicle, trailer, watercraft, caravan or aircraft. Such costs have to be covered under an iWYZE Vehicle policy.
- Dishonesty - The legal action arises out of dishonesty, violence or indecency on my part.
- Subsidence Dispute - The legal action arises out of a dispute regarding subsidence of land.
- Divorce - The legal action arises out of divorce, custody, maintenance, guardianship or similar proceedings.
- Copyrights - The legal action arises out of patents, copyrights, trademarks or tradenames, or other similar rights.
- Defamation - The legal action arises out of defamation, insult to dignity and reputation of a person.
- Same Policy - Any costs arising from legal actions between two or more people insured under the same iWYZE policy.
- Foreign Countries - Costs arising from legal actions happening outside of the Republic of South Africa.
- iWYZE - Costs arising from legal actions between myself and iWYZE.
- Approval outstanding - Legal costs incurred without the approval of iWYZE.
